The failure of a potential design owner to obtain effective design patents will likely enable competitors to take the essence of his or her products’ designs. Copying of designs can adversely affect the sales of products and prevent the company that produces the products from fully realizing potential profits. The failure to adequately protect designs can also subvert branding efforts and adversely affect the potential future success of products or models yet to be made.
A successful design patent portfolio, in contrast, prevents knockoffs from competing with original products for sales and minimizes the likelihood that valuable and well-protected portions of designs will be incorporated into third-party products.
